FSSAI Introduces Perpetual License Validity: A New Era of Continuous Compliance for India's Food Businesses
For years, food businesses across India have operated under a familiar compliance cycle obtaining an FSSAI license, monitoring its validity period, preparing renewal documents, paying renewal fees, and undergoing periodic inspections. This recurring process demanded significant administrative effort, particularly for small and medium food business operators.
From 1 April 2026, this long-standing system has undergone a landmark transformation.
Through the Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026, notified on 10 March 2026, the Food Safety and Standards Authority of India (FSSAI) introduced perpetual validity for food licenses and registrations. The reform represents one of the most significant changes to India's food regulatory framework in recent years, replacing the traditional renewal-based system with a model centered on continuous compliance.
What Has Changed?
Under the previous licensing framework, FSSAI licenses were issued for a validity period ranging from one to five years, after which food business operators were required to apply for renewal. Failure to renew within the prescribed timeline could result in penalties or suspension of business operations.
Under the amended regulations, all FSSAI licenses and registrations issued on or after 1 April 2026 remain valid indefinitely unless cancelled or suspended for non-compliance with food safety regulations.
This eliminates the need for periodic license renewals, reducing administrative burden while allowing businesses to focus on maintaining compliance throughout their operations.
Perpetual Validity Does Not Mean Permanent Compliance
Although license renewals have been abolished, the responsibility of complying with FSSAI regulations remains unchanged. The perpetual validity framework is based on the principle of continuous regulatory compliance.
Food business operators must continue to fulfil the following obligations:
• Annual Payment of License Fee: The prescribed annual fee must be paid every year. Failure to do so results in automatic suspension of the license until all dues and applicable penalties are cleared.
• Compliance with Food Safety Standards: Businesses must continue adhering to the hygiene and operational requirements specified under Schedule 4 of the FSSAI regulations.
• Submission of Statutory Returns: Businesses required to file annual or periodic returns must continue doing so within the prescribed timelines.
The new system replaces periodic license renewal with ongoing compliance monitoring.
Benefits Across the Food Business Ecosystem
The reform is expected to benefit businesses of all sizes while simplifying regulatory processes.
Street Vendors and Small Food Businesses
Street vendors operating under recognized vending laws are now deemed registered under FSSAI, eliminating duplicate registration procedures and reducing compliance costs. This measure is expected to benefit millions of small food vendors across the country.
Expanding Food Businesses
Revised turnover thresholds introduced alongside the amendment allow many businesses to remain within lower regulatory categories even as they grow. This simplifies the transition between registration and licensing categories and reduces unnecessary administrative procedures.
Emerging Food Business Models
Cloud kitchens, home-based food businesses, online food brands, and other modern food business models benefit from a simplified licensing framework without the recurring pressure of license renewal.
Shift Towards Risk-Based Regulatory Oversight
The introduction of perpetual licenses is accompanied by a significant change in FSSAI's inspection approach.
Instead of conducting inspections primarily around license renewal periods, regulatory authorities will increasingly adopt risk-based inspections, prioritizing businesses according to the nature of food handled and associated food safety risks.
This allows enforcement agencies to concentrate resources on higher-risk establishments while reducing unnecessary inspections for consistently compliant businesses.
What Happens to Existing License Holders?
The amendment applies differently depending on the status of an existing license.
• Businesses holding valid licenses issued before 1 April 2026 will continue under the existing validity period. Upon their next renewal, the renewed license will acquire perpetual validity.
• License applications that were pending before 1 April 2026 due to document verification, inspections, or regulatory queries but are approved on or after that date will automatically receive perpetual validity without requiring a fresh application.
This ensures a smooth transition from the old licensing framework to the new perpetual validity system.
Reduced Compliance Burden
One of the primary objectives of the amendment is to improve the ease of doing business within India's food sector.
By eliminating recurring licence renewals, the new framework significantly reduces:
• Administrative paperwork
• Repeated interactions with licensing authorities
• Periodic renewal costs
• Operational disruptions associated with licence expiry
Businesses can instead devote greater attention to food safety management and operational excellence.
Revised Turnover Thresholds
The amendment also revises the financial thresholds applicable to food businesses:
• FSSAI Registration: Up to ₹1.5 crore annual turnover
• State Licence: Above ₹1.5 crore and up to ₹50 crore
• Central Licence: Above ₹50 crore annual turnover
These revised limits place a larger number of businesses under simpler compliance categories while ensuring appropriate regulatory oversight for larger operations.
What Food Businesses Should Do
Food business operators should now focus on maintaining continuous compliance rather than preparing for licence renewals.
Businesses should:
• Ensure annual licence fees are paid on time.
• File all applicable statutory returns within prescribed deadlines.
• Maintain hygiene, food safety, and operational standards as required under FSSAI regulations.
• Monitor turnover to determine the appropriate registration or licensing category.
• Complete any pending licence applications promptly to benefit from perpetual validity where applicable.
Conclusion
The introduction of perpetual validity for FSSAI licences marks a significant evolution in India's food regulatory framework. Rather than relying on periodic licence renewals, the new system emphasises continuous compliance, accountability, and risk-based regulation.
For compliant food businesses, the amendment reduces regulatory burden, lowers administrative costs, and improves operational continuity. At the same time, FSSAI retains robust enforcement powers through annual compliance obligations and targeted inspections.

Perpetual validity is not the end of compliance; it is the beginning of a more efficient, continuous, and responsible compliance framework for India's food industry.

The Food Safety and Standards Authority of India (FSSAI) has introduced an important labelling update for Coffee–Chicory Mixtures, allowing manufacturers to display the percentage composition of coffee and chicory on the front of the package to enhance consumer transparency.

Key Labelling Requirement

✔ Packages with Principal Display Panel (PDP) area below 100 cm²: Minimum font height 1 mm

✔ Packages with Principal Display Panel (PDP) area of 100 cm² and above: Minimum font height 2 mm

This additional declaration aims to improve consumer awareness while ensuring greater transparency in food labelling. The declaration is optional but, if used, must comply with the prescribed format and font-size requirements.
