Ploughmans and Countdown Bricks Farm Giveaway 2022 Promotion on Meta™ Terms and Conditions:
1. Instructions on how to participate form part of these Terms and Conditions. Participation in this promotion is deemed to be acceptance of the Terms and Conditions.
2. The Promoter is George Weston Foods (NZ) Limited, 666 Great South Rd, Ellerslie, Auckland 1051 (“Promoter”). To contact the Promoter, please email [email protected] or telephone our New Zealand customer service line on 0800 847 867.
3. The Promotion is open to North Island, New Zealand residents excluding employees and contractors of the Promoter and any agency involved with this Promotion, and the immediate families of such employees and contractors (“Entrant”).
4. The promotion commences on Friday 11th November 2022 and closes on Thursday 17th November 2022 (“Promotion Period”). Entries received after 11:59pm on Thursday 17th November 2022 will not be entered into the promotion.
5. Enter into the promotion by commenting on the promotion post posted on the official Ploughmans New Zealand page, available at https://www.facebook.com/ploughmansnz/ and Instagram page, available at https://www.instagram.com/ploughmansnz/ during the Promotion Period (“Promotion Post”).
6. Entrants must enter using their own Facebook and Instagram account. Only one entry is permitted per person. Entries are deemed to be received at the time they are received by the Promoter, and not at the time of transmission by the entrant. Any entries received outside of the Entry Period will be null and void and will not be entered into the Promotion.
7. 3 Prize winners will be selected. The winners will be drawn at random taken from all entries during the Entry Period. The winners will be decided on insert 2022.
8. The winners will each receive 1x Countdown Bricks Farm full set valued at insert (“Prize”). The winners will be notified by a reply to their comment on the Promotion Post . In the event that an ineligible entry is chosen, or the Promoter is unable to contact a winner within 24 hours of the winner being notified, having made reasonable attempts to do so, the Promoter may deem that winner’s entry invalid and select a new winner on the same terms as the original Prize draw. If a winner cannot accept or take part in the Prize for any reason, the Prize will be void and no compensation will be provided.
9. Winners must provide the Promoter with a valid New Zealand residential delivery address within 24 hours of being contacted by the Promoter. Where the Promoter does not receive a winner’s valid New Zealand residential delivery address by this time, their Prize will be void, and no compensation will be payable. The Prize will be delivered to the particular address nominated by the Prize winner. Delivery of the Prize is valid to any residential address in New Zealand.
10. Failure by the Promoter to enforce any of its rights at this stage does not constitute a waiver of those rights.
11. The Prize cannot be exchanged for cash.
12. The Promoter is not liable for any loss, damage or injury suffered (even if caused by negligence) as a result of any winner accepting and/or using a Prize, except for any liability which cannot be excluded by law.
13. In the event that the Prize or any part of the Prize becomes unavailable for any reason beyond the Promoter's control, the Promoter may in its sole discretion decide to provide an alternative prize.
14. The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons. If an entry is deemed inappropriate or offensive, it will be removed by the Promoter in its sole discretion and the Entrant will not be eligible to win a Prize.
15. The Promoter reserves the right, at any time, to verify the validity of claims and determine the eligibility of entrants (including an Entrant's identity) and to disqualify any entry or refuse to award a Prize where false or misleading details have been given by an Entrant, or where an Entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these terms and conditions or the spirit of the Promotion.
16. The Promoter reserves the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this Promotion, has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.
17. Neither the Promoter nor any other entity associated with this promotion will be responsible for any late, lost, misdirected or incorrectly submitted entries, including but not limited to entries not received due to technical problems or human error.
18. The Promoter collects personal information in order to conduct the promotion, contact winners, and deliver prizes. The Promoter may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. Eligibility to win a Prize is conditional on providing this information. By entering the promotion, the Entrant consents to the Promoter, unless otherwise advised, using the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. Under the Privacy Act 2020, entrants have the right to access and correct any such personal information.
19. Entrants warrant that their entry is not in breach of any third party intellectual property rights. To the fullest extent permitted by law, Entrants agree to indemnify the Promoter and its associated agencies against all losses, damages, claims and costs by third parties arising out of, connected to, or resulting from, a breach of the warranty set out in this clause.
20. An Entrant's entry must not include:
a) any image, video or voice of any other person without that person's express consent;
b) any content that contravenes any law; and
c) any content that is obscene, offensive, potentially defamatory, discriminatory, indecent, prejudicial or inconsistent with prevailing community standards.
21. By entering this Promotion, Entrants grant the Promoter a non-exclusive licence to use the content of their entry, or any part of the content of the entry, in any way the Promoter wishes (including modifying, adapting, copying, cropping, retouching, editing, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media for the purposes of the Promoter's business on its website, social media or in any marketing campaign, without payment to the Entrant of royalties or compensation. If requested by the Promoter, eligible Entrants agree to sign any further documentation required by the Promoter to give effect to this clause.
22. By entering this Promotion, Entrants consent to the Promoter dealing with their entry content in any way that may otherwise infringe the Entrant's moral rights, and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against the Promoter or its assigns, licensees or successors.
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting this Promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
24. This promotion is in no way sponsored, endorsed, administered by, or the responsibility of, Facebook or Instagram. By entering this promotion, you understand that you are providing your information to the Promoter and not to Facebook or Instagram. The information you provide will be held and used only for the purpose of this promotion. Each Entrant agrees to comply with Facebook’s and Instagram’s terms of use (as relevant) and completely releases Facebook and Instagram from any and all liability in relation to this Promotion.
25. Except for any liability that cannot be excluded by law, the Promoter (including its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies), excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected ; (d) any variation in the Prize; (e) any tax liability incurred by a claimant or entrant; or (f) use of a prize.

If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend any aspect of the Promotion (including any Prize or term), or invalidate any affected entries.
