Effective January 2015
Please read below the following Terms and Conditions (hereinafter referred as T&Cs) carefully before placing your order with Cupcake Cravings. This agreement is hereby entered into between Cupcake Cravings and you (hereinafter referred as Client). GENERAL
1) Client acknowledges and agrees that Cupcake Cravings will not be liable to Client or any other person for any direct,
indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for product liability, personal injury or negligence resulting from use of goods supplied to or on behalf of Client.
2) Cupcake Cravings reserves the right to change this T&Cs without notice. T&Cs published by Cupcake Cravings will always be the latest and will supersede any prior T&Cs provided in any form. FOOD PRODUCTS
1) Please be aware that Cupcake Cravings product may/could contain traces of nuts. It is the Client's responsibility to inform their guests that traces of nuts may/could be present in the cupcakes. Cupcake Cravings will not be held responsible for anyone suffering from nut allergies.
2) All efforts will be made by Cupcake Cravings to supply the products agreed upon at the time of booking. However, Cupcake Cravings will not be held responsible if the products are not available as a result of, but not limited to, unavailability, seasonal variation or poor quality. Cupcake Cravings reserves the right to use its discretion to supply similar or substitute high quality product under such circumstances and will try where possible to agree this alternative product with the client prior to supply. SALES
1) A minimum of two days notice is recommended for cupcake orders as Cupcake Cravings schedules your order to be baked fresh for Client's required meetup/pickup date.
2) Cupcake Cravings strictly follows NO ORDER FORM, NO ORDER SUBMITTED. Cupcake Cravings will not be held liable for orders informally submitted via, but not limited to, SMS, Viber, email, or any other social networking sites, which were not processed or delivered. Thus, Client agrees to submit their final order through the order form via Viber, SMS or e-mail only. Cupcake Cravings confirms the order submitted by the Client by sending an order confirmation message to the Client.
3) Client pays for the order via Cash on Delivery (hereinafter referred to as COD) or Bank Deposit. Bank details will be sent by Cupcake Cravings through the order confirmation message. Cheques will not be accepted.
4) For orders worth PhP1,000.00 and above, Client is required to pay 50% deposit through Bank Deposit. Otherwise, mode of payment may be COD or Bank Deposit depending on Client's choice.
5) Deposits to be made by Client must be paid within 48 hours from date of order, otherwise orders will be deemed cancelled or not final and will require resubmission of order form. CANCELLATION OF ORDERS AND/OR REFUNDS
1) The following will apply if for any reason Client requires the cancellation of cupcake orders:
- All requests for cancellation must be made within 24 hours from date of order.
- All requests for cancellation must be sent via email ([email protected]) ONLY.
- All deposits are non-refundable.
2) In the event when Cupcake Cravings is unable to supply the order on the agreed date due to unforseen circumstances (for reasons including, but not limited to, illness, accident, injury, or bereavement), Cupcake Cravings reserves the right to cancel the order and will provide Client with a full refund. PICKUP/MEET UP
1) Cupcake Cravings will not be liable for any damages that may occur after the product has been collected and setup.
2) When a third-party is used to deliver and setup the product, Cupcake Cravings will not be held liable for any damages that occur during delivery transport and setup.
3) If Client is not able to show up on agreed date of meetup/pickup, Cupcake Cravings will contact Client to arrange re-delivery or reserves the right to cancel the order. For re-deliveries, Client may incur an additional fee.
4) Client agrees to a handling fee that applies for orders 24 pieces and below. Cupcake Cravings has the right to waive the handling fee for orders above 24 pieces.
5) Client agrees that late delivery does not constitute a failure in agreement and does not entitle Client to cancellation or refund of an order. CLIENT'S OBLIGATION
1) To read this Terms and Conditions thoroughly and carefully. By using Cupcake Cravings' service, Client agrees to be bound by these terms and conditions.
2) To submit a complete and duly accomplished order form through SMS, Viber, or email to [email protected]. Cupcake Cravings will not be held liable for errors in the product which resulted from lack of order information.
