On this Labor Day - and every day - we recognize and appreciate the skilled farmworkers who help produce the fresh fruits, vegetables, milk, and other foods we all enjoy.

When it comes to collective bargaining, it is time to ensure farmworkers’ rights are exercised through a transparent and secure process. We will keep working with farmworkers, lawmakers, and regulators to ensure New York finally delivers the same rights and protections to farmworkers that every other worker in America already has.

The Grow NY Farms coalition reiterated its support for PERB-supervised secret-ballot elections for farmworkers seeking union representation, and said it plans to continue working with state policymakers as the proposed regulations move through the rulemaking process.

Grow NY Farms has responded to proposed rulemaking recently published by the NYS Public Employees Relations Board (PERB) governing procedures under the state’s farm labor law.

“We appreciate PERB making progress to bring more clarity and fairness to the unionization process, and not only for family farm employers but most importantly, for farmworkers,” said Brian Reeves, family farmer and president of New York State Vegetable Growers. “Elements of this proposal reflect concerns we have raised for years, including the right to decertify. Since day one, we’ve advocated for fairness for farmworkers to ensure equal rights with every other private sector worker, including protected freedom of speech and secret ballot elections, as they are a fair, transparent, and democratic process. While some aspects of PERB’s latest rulemaking are an encouraging step in the right direction, other parts of the proposal could continue to result in unintended consequences, including impeding farmers from an informed and protected choice. We look forward to more progress being made that will protect farmworkers’ rights.”
