🎉 THE SPECIAL USE PERMIT PASSED! 🎉

We’re so excited to share that our Special Use Permit was approved, which means markets can officially return to The Yard!

Give us a little time to get everything organized — but we’re hoping our Winter Market will be the first one back! ❄️🎪 More details coming soon.

For now, we’re celebrating! Kids on bikes get a FREE small ice cream this Friday from 3–6 PM! 🚲🍦

And here we are.

At the December 15 City Council meeting, The Yard and its owners were publicly called out — comments that were then quoted in the Transylvania Times:

“So mis-using the temporary zoning permit has led us to this point where we have to make more regulations. The intent is if you are doing it temporarily you get a temporary use permit. If you’re doing it permanently you follow these regulations that are clearly in our ordinances and always have been there.”

And now we know the Transylvania Farmers Market operates — still today, year-round — as a temporary use.

The same permitting path we were directed to use.

And when our markets began, “flea market” wasn’t even an available land use. It wasn’t added until months later.

He was right about one thing:

“We wouldn’t need laws if people just did the right thing.”

After being publicly blamed for using the permitting process we were given, while another market continues to operate year-round as a temporary use?

That just rubs me the wrong way.

The details matter. So does the public record.

What you are listening to:

Audio from the September & October 2025 Brevard Planning Board meetings discussing changes to temporary-use regulations and farmers markets.

The City itself was discussing the Transylvania Farmers Market as a temporary use.

In September, staff acknowledged that it operates on private property as a temporary use, but is “city sponsored and recognized.”

In October, staff explained that the City makes an annual allocation to the market and was working with the City Attorney to ensure its continued operation.

Under the new rules, City-sponsored temporary uses could operate longer than 90 days, without a waiting period, and more than five times per year.

Meanwhile, “Farmers Market” was eliminated as a land use from the UDO. Even its definition was deleted.

Now The Yard is seeking a Special Use Permit for a “flea market” because Farmers Market is no longer an available land use. That means a quasi-judicial hearing under an entirely different land-use designation.

And the Transylvania Farmers Market operates as a temporary use — not a flea market.

The Yard is fortunate to be in a district where a flea market can be considered. Other districts that previously allowed farmers markets don’t even have that option.

The City eliminated Farmers Market as a land use while working to ensure the market it financially supports could continue as a City-sponsored temporary use.

None of this discussion appears in the published Planning Board minutes. You can listen for yourself on the City website.

How is eliminating a previously allowed land use not considered down-zoning?

Why does a farmers market receiving our tax dollars get an exception from restrictions imposed on everyone else?

How are residents supposed to trust the City when critical discussions like these are absent from the official minutes?

Most importantly, how is taking away the ability for positive things like markets and community events to happen outside of the Heart of Brevard good for ALL of Brevard?

The Heart of Brevard is not the SOUL of Brevard.

The people are.

Thank you to the writers, photographers, and the team at Our State for including Brew Cycle and the ’99’ Creemee Stand in this celebration of North Carolina’s Airstream culture.

Most of all, thank you to our amazing community. From the families who spend their afternoons at The Yard to the visitors who stop along the Ecusta Trail, you are the reason this little dream continues to grow.

Year 2 of the Adopt-A-Green-Space meadow.

This area was planted from seed with little bluestem, Virginia wildrye, coreopsis, black-eyed Susan, mountain mint, asters, goldenrod, milkweed, native beardtongues, and other Appalachian meadow species.

Right now you’re mostly seeing the coreopsis lanceolata in bloom, but later this year the black-eyed Susans and many of the other species should start to emerge as well.

You can also see black gum, paw paw, and itea throughout the meadow.
