Case update: the judge has agreed with the Health Dept's attorney that there are no material facts in dispute in the case, and has dismissed the case! We have appealed to the Missouri Supreme Court because our case was about a Constitutional issue -- the Right to Farm Act.

Thank you for the supporters who came to our hearing yesterday. The judge claimed she could be impartial, denied our motion to recuse, and then set out to prove it. We went through all 10 of the interrogatories (questions) that we felt the other side had not answered satisfactorily. She did throw some out due to the fact that they required a legal opinion, but overruled several of their objections which means they have to answer them. She will allow us to re-phrase and re-submit. Overall, we were pleased with the outcome.

Next, we'll tighten this up and resubmit, hoping to get better information in the discovery phase of this case.

Thanks again! We'll let you know when the next hearing is. We appreciate your help, and you know that you are fighting the good fight to keep our freedoms and access to good food. Thanks to all who couldn't make it but prayed for and thought about us, too.

Hello everyone,

Our case in Christian County against the Health Department goes on. This Friday, there will be a hearing at the Justice Center on the Square in Ozark at 9 a.m. We would like to ask for your support once again through prayer and attending this hearing. This time, the judge has before her our Motion to Recuse (we want her to step down), and also a Motion to Compel the other side to answer our questions. Their first answers were evasive and unsatisfactory, and they have refused to answer our appeal, so we scheduled this hearing to see if the judge will compel them to provide real information.

Thank you all for your continuing support while we continue the fight to be able to deliver our milk to a pre-arranged pickup point rather than to individual customers' homes, as the Christian County Health Department is pressuring us to do. They are disregarding the intent of the Missouri legislature. This would effectively end our delivery to Christian County.

I think the judge is always impressed, when our hearing is over, that a good part of the spectators get up and leave. That tells her that we have support and interest in this case, and that people are watching what she does.

This is a very important piece of legislation In a nutshell:

Specifies that residents have the right to sell directly to a buyer or purchase directly from a seller any farm-direct goods produced within the state without being subject to any state or local regulation

Some of you know about this bill already. It is the one I asked Mike Moon to sponsor. Mike has stepped up to the plate and is fighting for YOUR rights and MINE. He needs our support in this.

We are seeing an increase of commercially grown and SPRAYED crops in our area. We oppose the use, and now apparently the increased use, of chemical sprays on crops, especially as we and our neighbors strive to raise clean, wholesome, uncontaminated food. Please take the time to read and make your comments to the USDA in opposition of hormone-disrupting chemicals into the air and into our bodies and food.
