For anyone who ships DTC to South Dakota, the state emailed this notice:

Age Verification- In addition, please make sure that you are either obtaining a copy of every customers ID at point of sale (and retaining the information for 3 years) OR using an age verification program such as Lexus Nexus or IDology to ensure the customer is not lying about their age. Failure to follow this process is a $1000.00 violation per shipment! Unfortunately we had to issue a few of these this year. Checking a box stating they are 21 is NOT sufficient for South Dakota.

TENNESSEE “NEW” SECRETARY OF STATE REQUIREMENT

Tennessee had a requirement on the books that they were not enforcing This changed April 5, 2022. All direct ship permit holders must register with the Secretary of State to obtain a Certificate of Authority to do business in Tennessee. Once registered, the business will have to file an annual report and may have additional business tax obligations. Sole proprietors and general partnerships are exempt.

Great news! Kentucky is opening up to direct shipments!! The legislation was passed and signed by the governor. The permitting process is now being worked out but expect the ability to apply in June or July.

Texas Direct Ship Permittees:
Starting September 1, 2019 the Texas Alcoholic Beverage Commission (TABC) is planning to start random audits of Out-of-State Winery Direct Shipper permittees. Texas would like to insure Direct Ship permittees are in compliance with Texas rules and regulations.
If you are chosen for an audit, they will want to see the following records:
• Texas Wine shipments reported
• Excise tax paid, if applicable
• Verification the gallons stipulation was applied (nine gallons per month/ 36 per year per Texas resident), and
• That a TABC certified carrier was used
If a permittee has ever received a non-compliance notice from TABC, they have a greater chance of audit. Permittee’s should always be prepared for an audit. All Direct Ship states are moving in this direction.
