The SoBe Celebration Sweepstakes (the “Sweepstakes”) starts December 19, 2014 at 12:01 a.m. Eastern Time (“ET”) and ends December 23, 2014 at 11:59 p.m. ET (the " Sweepstakes Period").
2. HOW TO ENTER: Participants must be a registered Twitter user in order to participate. Follow on Twitter and tell us your favorite holiday moment in 140 characters or less to your Twitter account www.twit
ter.com (“Website”) and include the hash tag before the Upload Deadlines (“Submission”). Your tweet must include the tagging of and you must follow in order to be contacted by the brand. Proof of delivery or receipt of Submission will not be deemed by Sponsor as proof of Submission into this Sweepstakes. SEE NOTIFICATION SECTION ON HOW YOU WILL BE NOTIFIED IF YOU ARE A WINNER
Submissions may not contain obscene, lewd or inappropriate text including, no third party trademarks (including but not limited to clothing), animals engaged with the product, acts of violence or acts that appear to cause harm to individuals or property, as determined in Sponsor’s sole discretion. Submissions that do not comply with these Official Rules or that otherwise contain prohibited, or inappropriate content as determined by the Sponsor, in its sole discretion, will be disqualified and will not be published or considered. Sponsor makes the final determination as to which Submissions are eligible to take part in this Sweepstakes and be considered for inclusion. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Twitter.
3. ELIGIBILITY: To be eligible to enter, you must be a Twitter account holder who is a legal resident of the U.S. residing in one of the fifty (50) United States or the District of Columbia who is at least 18 years of age or older throughout the Sweepstakes Period. Employees of South Beach Beverage Company, Pepsi-Cola Company (“Sponsor”) and its bottlers, PepsiCo, Inc., and each of their respective parent companies, subsidiaries, affiliates, divisions, distributors, suppliers, printers, distributors and advertising, promotional and judging agencies and the immediate family members of such employees (parent, child, sibling, spouse) and persons living in the same household as such employees (whether related or not) are not eligible to win.
4. PRIZES: Grand Prize: Ten (10) Grand Prize winners will be awarded, each consists of one (1) Holiday package including one (1) desktop digital frame and one (1) SoBe Fuji Film Finepix camera (approximate retail value (“ARV”) $225).
5. DRAWING: Potential winners will be selected in a random drawing from among all eligible entries received throughout the Sweepstakes Period. Odds of winning depend upon the total number of eligible entries received. Drawing will occur on or about December 23, 2014 and will be conducted by an independent judging organization, whose decisions shall be final and binding.
6. GENERAL: Sweepstakes is subject to the laws of the United States only. Any difference between stated approximate value of prize and actual value of prize will not be awarded. Prize winners will be solely responsible for all applicable federal, state and local taxes on prize. All other expenses on the receipt and use of a prize not specifically mentioned herein are solely the responsibility of the winner. In the event of dispute over the identity of a potential winner, an entry will be declared made by the authorized account holder of the email address submitted at the time of entry.
7. CONDUCT: By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges that shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of the Sweepstakes.
8. LIMITATIONS OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of the Internet or the websites or any combination thereof, or; (e) any injury or damage to participant’s or to any other person's computer which may be related to or resulting from any attempt to participate in the Sweepstakes or download any materials in the Sweepstakes.
9. WINNER NOTIFICATION: Winners will be notified via Twitter. Any winner notification returned as undeliverable will result in prize forfeiture and an alternate winner may be selected at Sponsor’s discretion. Potential winners may be required to sign and return to Sponsor an Affidavit of Eligibility/ Liability Release with (where lawful) a publicity release for receipt by Sponsor by the due date indicated in the notification letter (which may be within seven (7) days or less of notification). If any required documents are not returned within the required number of days, or if any mail is returned as undeliverable without forwarding address, then prize may be forfeited and an alternate winner may be selected at Sponsor’s discretion. If you do not reply with your address within seven (7) days of being contacted the prize may be forfeited and an alternate winner may be selected at Sponsor’s discretion.
10. RELEASES: All entrants, as a condition of entry into the Sweepstakes, agree to release PepsiCo, Inc., Pepsi-Cola Company, its bottlers, Twitter and each of their respective parents, subsidiaries, affiliates, divisions, distributors, suppliers, printers, distributors and advertising, promotional or judging agencies (collectively “Released Parties”) from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: accessing any of the websites; submitting an entry or otherwise participating in any aspect of the Sweepstakes; the receipt, ownership or use of any prize awarded; preparing for, participating in or traveling to and/or from any prize-related activity, or; any typographical or other error in these Official Rules or the announcement of offering of any prize.
